1. Website
1.1 This website is owned and operated by Eurowines Limited.
1.2 Eurowines Limited offers this website, including all information and services, to you the ‘user’ subject to your acceptance of our ‘Terms and Conditions’ as outlined below and our ‘Privacy Policy’.
1.3 We encourage you to read and familiarise yourself with our Terms and Conditions before purchasing from us.
1.4 Trade customers contact us for separate Terms and Conditions of Sale. 
1.5 All products available for sale on this site are priced in GBP/£/Pound Sterling. 

2. Definitions
2.1.       The “Seller” means Eurowines Limited.
2.2        The “Buyer” is the person or company buying the Goods under these terms and conditions. Trade buyers must refer to our Trade Terms and Conditions.
2.3.       The “Goods” means the goods which are to be sold under a contract of sale between
the Seller and the Buyer.

3. Age Restriction
3.1 It is against the law for anyone under the age of 18 to buy, or attempt to buy, alcohol or for
anyone over the age of 18 to attempt to purchase alcohol for any person under the age of 18.
3.2 By placing an order with Eurowines, you are confirming that you are over the age of 18.
3.3 Eurowines reserve the right to refuse the sale of alcohol to any ‘Buyer’ we believe may be underage.
3.4 Our couriers also reserve the right to refuse to deliver goods if they suspect the recipient is not over the age of 18. You may be asked for ID on delivery.

4. Formation of Contract
4.1. We reserve the right to refuse service to anyone for any reason at any time.
4.2. Placing an order on our website is treated as an order request and is not a legally binding contract.
4.3. All orders shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions. Acceptance of Goods at delivery shall be deemed conclusive evidence of acceptance of these conditions.
4.4. A contract is formed only when we have confirmed your order in writing and dispatched your purchase. We will endeavour to inform you immediately of any shortages of stock which prevents us from fulfilling your order.
4.5. Non-acceptance of an order / order request may be a result of one of the following:
            1. The product is unavailable.
            2. We were unable to obtain confirmation of your payment.
            3. The identification of a pricing or product description error.
            4. The repeated or fraudulent use of Promotion Codes.
            5. There is reasonable doubt of age of the purchaser.    
4.6. If your order item(s) are unavailable, a refund will be made against any payments or part payments received.

5. Payment & Pricing
5.1. Prices involved will be those ruling at the date of despatch of the Goods.
5.2. Subject to Clause 5.1, all quoted prices are subject to change without notice.
5.3. All prices are quoted in Sterling, duty paid and inclusive of value added tax which will be charged at the rate in force at the time of despatch of the Goods.
5.4. All orders are in multiples of a full, unmixed case (unless stated otherwise).
5.5. Any order below £300 inclusive of VAT is subject to a delivery charge. We reserve the right to amend the cost of the delivery charge without notice.
5.6. Our payment service provider is WorldPay. For more information visit                           http://www.worldpay.com/.
5.7. If preferred, the Buyer can make a Sterling/£/GBP payment by credit or debit card over the telephone or via Bank Transfer. Contact us for details.
 
6. Delivery
6.1. We aim to process and dispatch your order within 48 hours of written confirmation, and will aim to deliver within 5 working days thereafter (subject to your location).  Working days are classed as Monday to Friday (excluding public holidays). 
6.2. Time and dates quoted for delivery are estimates only.
6.3. Delivery takes place when the Goods are delivered to the ground floor entrance of the building of the Buyer’s premises as stated in the order.
6.4.Our delivery partner is fully insured to carry your order.
6.5. Our delivery partner will make reasonable attempts at delivery.  If the Buyer fails to accept delivery or respond to calling cards or email/telephone calls from our Customer Service team, the delivery will be returned to our warehouse. It is the Buyer’s responsibility to communicate to us any issues relating to the delivery. 
6.6. There may be a charge for re-delivery.
6.7.  The Seller shall not be liable in any way for any losses, damages or expenses (whether direct, indirect or consequential) suffered by the Buyer due to any delay in failure in delivering the Goods.
6.8. We deliver to all United Kingdom mainland destinations, with exception of P.O. boxes.
6.9.  Deliveries to UK non-mainland addresses may be subject to a delivery surcharge. Please contact us for a quotation.
6.10. We are unable to deliver outside of the United Kingdom.
 
7. Short Delivery/Wrong Product Delivered/Non-Delivery
7.1. No claims for short delivery, damage to Goods or delivery of wrong product(s) shall be made unless the Seller is notified within 24 hours of delivery.  In the absence of such notification the  Buyer shall be deemed to have accepted the Goods.
7.2. It is the Buyers responsibility to advise the Seller of non-delivery of Goods within 14 days of confirmation of order. In the absence of such notification the Buyer shall be deemed to have accepted the Goods.

8. Damage in Transit
8.1. Goods damaged in transit must be reported to the Seller by signing the delivery note or ePod “damaged on arrival”. The Buyer must then inform the Seller by e-mailing weborders@eurowines.co.uk or calling our dedicated Customer Service team.  Any damaged Goods must be retained (including wrappings, cartons etc) for inspection.   Alternatively, damaged Goods may be refused and returned with the delivery driver.
8.2. In the event that the delivery note was signed but not marked “damaged on arrival” the Seller cannot be held responsible for any alleged damage in transit.

9. Return of Goods
9.1. Goods cannot be accepted for return without the prior consent of the Seller which will be given at the Seller’s discretion.
9.2. A collection charge will be payable by the Buyer for return of any Goods accepted by the Seller (see 9.1).
9.3. Any Goods returned in accordance with this clause 9 must be in pristine condition and returned correctly packed in its original packing.

10. Cancellation & Refund Policy
10.1. Under the Consumer Contracts Regulations, it is your right to cancel an order from the moment you place it, and up to 14 days from the day you receive your goods. 
10.2. To cancel your order, advise us in writing by e-mail or by calling our dedicated Customer Service team. You can contact us on 0870 162 1420 (option 3) or by e-mail at weborders@eurowines.co.uk. Call charges vary according to your network or service provider.  Feel free to e-mail us with a contact number and one of the team will call you back.
10.3. Your unwanted Goods should remain unopened and intact, and kept in good condition until collection has been arranged. 
10.4. We will arrange collection of any unwanted Goods received within the timeframe stated in clause 13.1 - a collection charge will apply which will be deducted from your refund. 
10.5. We will reimburse all monies for the returned Goods within 30 days of receipt of returned Goods.  Refunds will be made to the payment card provided with your original order.
10.6. If the Buyer fails to make the goods available for collection within 30 days of notice of cancellation, the Buyer will be deemed to have accepted the goods.
 
11. Quality of Goods
11.1. Save as expressly provided, all warranties and conditions relating to quality, or compliance with description (whether implied by statute or otherwise) are hereby excluded to the extent permitted by law PROVIDED THAT nothing in these conditions shall restrict or exclude liability for death or personal injury caused by the negligence of the Seller.

12. Inability to Supply
12.1. Without prejudice to any other condition hereof if any product shall not be available at the Seller’s UK warehouse or should the despatch or delivery of the whole or any part of the Goods be interrupted, prevented or hindered  by any cause or causes whatsoever beyond the Seller’s control, the Seller shall be entitled to postpone or suspend any delivery or deliveries until (in the Seller’s reasonable judgment) any such clause has ceased to operate. The Seller shall be under no liability whatsoever in respect of such postponement or suspension.
12.2. If the Seller does not apply to supply any Goods due to its unavailability at its warehouse or if despatch or delivery is delayed for more than one week, the Seller has the option of cancelling the contract and refunding any payment made by the Buyer.
 
13. Product Changes
13.1. Vintage wines are subject to change.  When a vintage changes then next available vintage will be supplied.

14. Miscellaneous
14.1.The contract shall be governed by and construed in accordance with English law and the parties hereto submit to the non-exclusive jurisdiction of the English courts.
